Privacy Notice for recruitment

This privacy notice (“Privacy Notice”) explains how Quickbit Group (hereinafter “Quickbit Group”, “Controller”, “we”, “us”, or “our”) and any company included in it, collects uses, processes, shares and transfers your personal within the recruitment process.
By submitting your personal data to us, you acknowledge that
you have read and understood this Privacy Notice and how we process your personal data as set out herein, and
your personal data may be transferred and processed for the purposes and in the manner specified in this Privacy Notice.
You are not required to provide any requested information to us but failing to do so may result in that we will not be able to process your application.
Data controller
Depending on what company within Quickbit Group you apply for a position at, the following company within Quickbit Group is the data controller in relation to and is therefore responsible for the processing of your data.

2. Information we collect and the collection sources
2.1. We will collect and process your personal data when you apply for a position in any of the Quickbit Group companies, communicate with us via third-party platforms or otherwise in relation to the recruitment process. When we fetch personal data from you or third parties it is because it is relevant for the recruitment process, or for other specified purposes. We will not use your personal data for any other purpose than the purposes covered in this Privacy Notice without prior notification to you or your consent.
2.2 Categories of personal data we collect directly from you when you apply for a position or otherwise communicate with us in relation to your application:
Data you have provided to us in your candidate profile, including first and last name, personal identification number and date of birth (where applicable), e-mail address, telephone number, residential address, postal code, citizenship, and/or residence, pictures, videos.
Data which you have provided to us in your application documents such as for example curriculum vitae (CV), cover letter, educational history, work experience, qualifications, other achievements, test-results, information on your language and other skills.
Data that you have provided during our interviews such as for example videos, interview notes, answers to questions asked during the recruitment process.
Where applicable, identity data such as a copy of driving license, passport, ID-card, work permit information.
Where applicable, data from case test results.
Any other information that you may share with us, for example during an interview.
2.3. Categories of personal data we collect from external sources when you apply for a position or otherwise communicate with us in relation to your application:
Data collected from third party platform such as LinkedIn. This is often referred to as “sourcing”. In such case, the potential applicant is covered by this Privacy Notice and will be informed about our processing by sharing the Privacy Notice with the potential applicant.
Data collected from our external partners e.g. recruiting firms/head-hunters.
Data provided to us by your references (where applicable).
In some cases, our employees can make recommendations about potential candidates and provide personal data about such candidates.
Information obtained from professional social networks, such as LinkedIn, job boards, third party platforms, and from other accessible online sources to the extent that you have chosen to make information public for the purposes of actively approaching you with job offers or for the purpose of confirming the accuracy of the information presented by you within the course of the application.
3. Why we process your personal data and the legal basis for such processing
The overall purpose of the collecting and processing of personal data is to manage recruiting. The lawfulness of the processing of personal data is our legitimate interest to simplify and facilitate recruitment.
When you submit an application for a position in Quickbit Group, our legal basis for collecting, storing and processing your information is GDPR article 6 (1)(b) – steps necessary to enter into a contract. For specific positions you might be asked to participate in a case test. The legal basis for any test is GDPR article 6 (1)(a) – consent.
If you sign an employment contract at the end of the recruitment process, we will start the pre-boarding process between the date of signing the employment contract and your first day with us (e.g. informing you about your office location, ways of working, choice of technical devices etc.). Our legal basis for collecting, storing, and processing your information for the pre-boarding process is also GDPR article 6 (1)(b) – necessary for the performance of a contract.
In the case where candidates who have been approached by Quickbit with an invitation to apply for a role (“referred candidates” or “sourced candidates”), our legal basis for collecting, storing and processing your information is GDPR article 6 (1)(f) – legitimate business interest. We have conducted a legitimate interest assessment and balanced out legitimate interest (finding suitable candidates) against the candidates interested and concluded that our interest outweighs the candidates’. We will only process information which you have made publicly available yourself.
Provided that we have obtained your consent, we may also retain your personal data in our candidate database for the purposes of future recruitments. The legal basis for such processing is then GDPR article 6 (1)(a) – consent. You may withdraw your consent at any time by contacting us.
Furthermore, we may process personal data about you where this is necessary to defend ourselves against legal claims arising from the application process that are brought against us. The legal basis for this Article 6 (1)(b and f) GDPR; the legitimate interest is, for example, a burden of proof in proceedings under the Swedish Discrimination Act (2008:567) or similar legislative acts in other countries, when the data controller for your data is a Quickbit Group company based outside Sweden.
Personal data that is processed with the purpose of aggregated analysis or market research is always made unidentifiable. Such personal data cannot be used to identify a certain User. Thus, such data is not considered personal data.
4. Retention and deletion of your data
We do not keep your personal data for any longer than is necessary for achieving the purpose(s) for which the personal data was first collected. Basically, this means that once the data is no longer needed in relation to a specific recruitment process, the data is deleted. Please note that certain data is retained even after a recruitment process is closed, such as data that we need to retain to protect our legal interests on the event of a discrimination claim. No data is however kept by us when it is no longer needed in relation to the legal basis with which it is processed.
If your application is successful resulting in an employment, the personal data we collected during the recruitment process will partly become part of your personal file and processed in according with the Employees Privacy Notice, which you will take part of before signing the employment contract with us. The personal data that have not become a part of your personal file will be deleted in accordance with our routines.
If you have agreed to let us retain your data in our candidate base for future potential recruitment, we will retain your data until you ask us to delete it or when we consider it not relevant in relation to our foreseeable recruitment plans.
5. Sharing of your personal data
We may share your personal information in the following circumstances:
Within Quickbit Group, to companies, relevant staff that is involved in the recruitment process and other staff that may have access to personal information where such access is required for their function, example the IT department, under common control and ownership as required for business administrations purposes.
Where necessary, to our recruitment firms and, where permitted by law, other professional advisors in order to perform pre-employment checks, and where necessary to obtain advice or otherwise protect and manage our business interests.
Some of our platforms and systems are provided by our subcontractors (“data processors”). As our subcontractors, they are only allowed to process your data according to our instructions and may not engage in unauthorized disclosure of your data.
When applicable, in connection with, or during negotiations concerning, any re-organization, merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. In certain circumstances, we may be legally required to share certain personal data we process such as for example where we are involved in legal proceedings, where we are complying with legal obligations, a court order, upon a legitimate request from a governmental authority, or to prevent and investigate fraud or other illegal activity to protect you and ourselves, including where necessary for the purposes of an investigation.
We may also compile statistics about the recruitment process. All such data will be anonymized and will not include any personal data, or any anonymized data that can be combined with other data and used to identify you. We may from time to time share such data with third parties such as recruitment firms.
6. Where we process your personal data
We always strive to process your personal data within the EU/European Economic Area (the “EEA”). However, in some situations such as when we share your data with for example an IT or hosting provider with operations outside the EU/EEA, your personal data may be processed outside the EU/EEA. In the event that a non-EEA country to which we transfer personal data has not obtained an adequacy decision from the European Commission, we have applied safeguards for any transfers of personal data to third countries, such as the EU Commission Standard Contractual Clauses.
7. Security
Data security is very important to us. We continuously undertake appropriate technical and organizational measures to ensure adequate security of your personal data throughout the processing.
We keep your personal data safe using fault-tolerant secured storage with industry standard encryption and implemented a number of security measures to ensure that your information is not lost, abused, or altered.
However, transfers of information over the internet and mobile networks can never occur without any risk, so all transfers are made on the own risk of the person transferring the data. It is important that you also take responsibility to ensure that the data is protected. It is your responsibility that the login information is kept secret.
8. Your rights as a data subject
As a data subject you have the right to exercise control over your personal data and to obtain information about how we process your personal data. You can contact us if you want to exercise any of your rights, please see section 10 below for contact details.
Right to access: you have the right to request information about the personal data we hold on you at any time.
Right to rectification: you have the right request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data completed.
Right to restriction: you have the right to request that we restrict to process your personal data under the following circumstances:
- if you object to processing based on legitimate interest, we shall restrict it pending the verification of the legitimate interest.
- if you have a claim that your personal data is incorrect, pending verification of the data accuracy.
Right to erasure: you have the right to ask to erase any personal data processed by us at any time without undue delay. Although we will meet any such request to the extent required under applicable law, please note we may still maintain that certain data (for example such as data which we need to keep following our legitimate interest or to protect our legal interests).
Right to data portability: whenever we process your personal data by automated means based on your consent or based on an agreement, you have the right to get a copy of the data transferred to you or to another party. This includes only the personal data you have submitted to us.
Right to object to processing based on legitimate interest: you have the right to object processing of your personal data that is based on our legitimate interest. We will not continue processing personal data unless we can demonstrate legitimate grounds for the process which overrides your interest or due to legal claims. If your privacy interests outweigh our interests in processing certain data, we will stop processing such data.
Right to withdraw consent: you have the right to withdraw your given consent about the personal data that we process about you at any time.
